By DON WINNER for Panama-Guide.com - Last night Brazilian businessman Alexandre Ventura Nogueira, formerly one of the principal operators of the widely known "Homes" real estate offices in Panama City, paid a bail bond of $1.4 million dollars set by Rodolfo Palma, the judge in the 17th Criminal Court responsible for hearing the fraud cases pending against him. In addition to the bail, there is also a restriction placed against Nogueria to prevent him from leaving the country. There are more than a dozen complaints pending against Nogueria, both criminal and civil, all having to do with allegations of fraud in real estate deals. Nogueira was in the headlines a few months ago when he was acting as a friend and confidant of Colombian David Murcia.

David Young, Eric Jackson, the "Star" and Porno in Panama

Published by Panama Guide under Crime & Punishment

Steven Rich, William Smartlee, and Ruth Osborn
Steven Rich, William Smartlee, and Ruth Osborn
By DON WINNER for Panama-Guide.com - I just had a conversation with David Young, the (supposed) editor of the English language section of the "Estrella" newspaper in Panama City. We had a long conversation about how Steven Rich basically suckered him into writing about the porno industry in Panama, using the alias "William Smartlee." Steven Rich spent at least seven months trying to get David Young to write about Fabian, all the while making the same false and fabricated charges, alleging Fabian was directly involved in the production, editing, sale, and distribution of child pornography from his offices in Panama City. David Young never fully identified his source - he only knew the "William Smartlee" Internet email alias and he never met face-to-face with the author of those emails. And it should be pointed out the allegations Steven Rich was making (as William Smartlee) were very serious indeed, if they were true. And although a string of other journalists before him examined those same allegations and decided there was nothing to them, David Young ran with the story, and in doing so made several more very significant errors in judgement along the way, as well as very questionable editorial decisions with regards to ethics, morals, and values. (more) What Do You Think? Editors have to make judgement calls all the time - that's their job. When the "Estrella" ran their article on 2 June 2009 written by Richard M. Koster, they made no mention of child pornography in the body of that article. Of course, they couldn't because they had no proof or evidence whatsoever, other than what had been provided to them in dozens of emails by Steven Rich writing under the alias of William Smartlee. But, no matter - it's relatively easy to stretch the rules and bend the truth when you have questionable or marginal journalistic morals, ethics, or values. On 2 June 2009 the "Estrella" published an article entitled "Porn capital of the world" - mostly about the "Panama Summit" meetings of porn company CEO's. But, David Young also wanted to somehow include the allegations being made by Steven Rich (as William Smartlee) with regards to child pornography. What to do, what to do? Eureka! How about if we run another story about child pornography, right next to the first one about "plain vanilla" (meaning, legal) pornography. That would allow them to have their cake and eat it too. So, on the very same day that the article ran about Fabian and the porn industry in Panama, they ran an article entitled "Fighting child abuse and pornography in Panama." The two article appeared side-by-side on the Internet version (which you can see if you click on this link:

Who Are You Trying To Bullshit? Steven Rich's obsessive attempts to cause harm to Fabian and his businesses by contacting at least five different news publications have been well documented in my article published earlier this week entitled "Expat Steven Rich Uses Online Aliases To Slander, Defame, Seek Revenge". David Young tried to tell me he was uninfluenced by the extensive exchanges of email between him and William Smartlee that stretched over more than seven months prior to the publication of these two articles on 2 June 2009. When I questioned the journalistic ethics of publishing these two articles side-by-side, he said "that's not true, the article about child pornography appeared on page two." Not on the internet, it didn't. The reader just has to shift his eyes a few inches to the right and "bingo" - David Young has made the leap for you. While Steven Rich (as William Smartlee) wanted the article about Fabian to directly include his allegations regarding child pornography, David Young took one baby-step up the ladder of ethical responsibility - and just separated the material into two stories. Slick. Legally, they're covered. It contains strong elements of plausible deniability - they can put on an innocent face and deny all knowledge of any linking the reader might make. But at the same time, now that Steven Rich's background and motivations have been exposed, to stand by this hatchet job is weak, spineless, and reprehensible.

Also In The Content: If you take the time to read the article supposedly about fighting child pornography in Panama, you will see it's full of references to how weak law enforcement capabilities supposedly are in this country (leaving the reader to understand - that's why nothing has been done against Favian.) "Whoops," again. The article starts off with "At a recent Latin American seminar in Argentina, Panama was identified as the country with the highest incidence of pornography." Can anyone tell me what that means? "Highest incidence of pornography?" What, exactly, is an "incidence of pornography"? Does that even make sense? Of course not - it's no supposed to. The reader is left to slip on the mental virtual banana-peel, and to subconsiously insert the word "child" in that line. What if the line had read "...highest incidence of child pornography." There, that's better, if you're out to sling some (hypothetical, virtual) arrows but you still suffer from the minor handicap of not having any actual proof. And, to say nothing of the professional neglect of not verifying the source. I mean, shit - it took me two days to figure out that "William Smartlee" was actually Steven Rich, once I set my mind to it. Really nice guys, eh? I wonder how long they sat down and pondered in front of the computer screen to come up with these gems. Now that we've got you thinking about pornography with the article about Fabian, consider the following (in the next article);

  • "(Panama) ... is also the center of a thriving child pornography industry which has already resulted in four major prosecutions." (Note: Steven Rich's false accusations said Fabian produced, edited, sold, and distributed child pornography.)

  • "Panama’s investigation of child pornography on internet sites is hamstrung with a lack of experts who can detect offenders on the internet." (Note: Steven Rich's allegations included explicit (but fabricated) details regarding how Fabian supposedly used his companies as a front to distribute child pornography.)

  • "While Panama does not have the sophisticated equipment and trained personnel to adequately fight the crime and identify local criminals, many high level investigations carried out in other countries, have been able to pin point users in Panama, who watched pornography from the investigating country, or have put material on site."

  • "Prosecution is made difficult by the “skill” of distributors who can “hide” child pornography on adult sites." (Note: Techniques and elements specifically referenced by Steven Rich writing as William Smartlee in his false allegations against Fabian.)

  • "In Canada where the RCMP (Royal Canadian Mounted Police) have a sophisticated network,..." (Note: Steven Rich writing as William Smartlee made several references to Canada and the RCMP in many of his emails pushing the child pornography story.)

  • “Currently we need to train technicians to deal with pornography and commercial and sexual exploitation. Those are areas that need reinforcement.”

Golly, Where Did That Come From? David Young and the owners of the Estrella should man-up and admit they were fooled by Steven Rich writing as William Smartlee. The story about the porn industry was, and still is, a "so what" story in my humble opinion because they are not doing anything illegal. This story has since morphed and transformed - it is now much more about how one man, Steven Rich, fueled by anger and a passion to exact revenge, first against Fabian and then later against me, manipulated and fooled David Young into publishing these articles. It's not about the porn, and it has never been about child pornography because those false and despicable allegations were a complete fabrication - created by Steven Rich out of thin air (now, by his own admission) in order to do as much harm as possible.

Then They Dragged Me Into It: I asked David Young if he was willing to stand by his article that supposedly "links" me to the porn industry (and, obliquely, child pornography) due to my weak association with Mona Sutherland. I pointed out that the letter written to Eric Jackson describing that supposed connection was written by Steven Rich who was still motivated by revenge because he was now out to do harm to my reputation, since he had already gotten away with doing as much as possible to Fabian. David Young admitted to me that Eric Jackson is mentally ill, unstable, and "obsessed" with me. When I asked him direct questions - like "why did you print my name in association with the porn industry?" - he all of a sudden became hard of hearing. Like, he didn't have a good answer, or any answer for that matter, so he just played dumb. And although David Young admitted knowing about Eric Jackson's obsession with me, he still (apparently) could not understand why I was upset about being linked to the porn industry in their newspaper. I asked him if they now intend to print the names of every other person who has ever had any kind of association with Mona Sutherland. He didn't understand the question - but it's obvious - they only published my name because of the letter written to Eric Jackson by Steven Rich. In short, both of those guys wanted to drag me into this mess, in order to cause me as much harm as possible, and David Young allowed it to happen.

You Get Into My Shit, I Get Into Yours: CIA? Nah, those guys are high drag and low speed, anyway. I explained that since David Young thought it was a good idea to publish my name and drag me into this, I was going to repay the favor. There have been several opportunities for the players in this little bullshit drama to "man up," admit their basic mistake, take corrective action, and walk away. But, David Young refused to do that. I simply ask them to remove the article entitled Porno host site or call center?, which says;

  • "...Eric Jackson said that Fabian (snip), a Dutch national is running a porn Website empire in Panama and made a connection with Don Winner..."

  • "Jackson said in his article that the connection between Don Winner and Fabian (snip) can be made with their relationship to Mona Sutherland..."

  • " The connections between them are tricky to prove because Mona Sutherland uses an alias...." (Note: Like "William Smartlee" perhaps?)

Why The Hell Are We Talking About Me? Easy - because Eric Jackson is both mentally ill and obsessed with me - like David Young said. And here's my complaint - if it were anyone else on the planet then they would not have printed their name. Once again, David Young basically screwed up "big time" when he followed Eric Jackson's lead on this.

What About The Email from "Ruth Osborn"? I also asked David Young about the email forwarded to him by Eric Jackson originally written by another one of Steven Rich's aliases, this time "Ruth Osborn", making (again, false) allegations that I have some kind of connection to the CIA. And once again, when I started asking hard and direct questions, David Young became hard of hearing. He seems to do that often when he's pinned into a corner. He finally made some weak excuse about "not reading most of the crap" forwarded to him by Eric Jackson.

Focusing On My Access To The Email: During our conversation David Young asked me three times how I obtained access to the extensive series of emails between Steven Rich and Okke Ornstein, Eric Jackson, El Siglo, and David Young. And I told him sorry, I have my sources, and I'm not about to explain them to him. He even made reference to "I can imagine you sitting in a courtroom defending that..." Yeah, so can I. As a matter of fact I'm looking forward to it, because what I find the most interesting is that the people who have gotten sucked into this entire mess by Steven Rich are all focusing on "how the hell did he do that" with regards to those emails. What they are not focusing on is "oh shit, we got played, now what..." And with regards to "what's the greater good?" - to establish the efforts of Steven Rich and his relentless and obsessive vendetta, stretching over more than nine months and contacts with five different news outlets in Panama, in an attempt to get someone (anyone) to publish his allegations in order to get his revenge on Fabian. Those efforts culminated with the publication of the series of articles in the "Estrella" - presided over by David Young. Make no mistake about it, as the Editor of the English language section of the newspaper, David Young is ultimately responsible for everything that's published. I expect the prosecutors and judges in these cases (criminal and civil, as well as appeals) will call everyone involved in those exchanges to verify the content of those emails. And, if David Young wants to raise his right hand in a Panamanian courtroom and lie under oath, then good luck with that. One thing you can bet on is that I'll be following the cases closely and writing about them as they proceed through the process to eventual conviction and judgement.

Wait A Minute - What Am I Doing? I just had an epiphany, a burst of insight, a stroke of genius. Since what matters to me most is being widely recognized as the most accurate and reliable source of English language news in the Republic of Panama, if fact it's a much better deal for me if the David Young - Eric Jackson tag team remains intact at the "Estrella." They blew this one in stellar fashion, and without a doubt it's only a matter of time before they slide down the road to "Okke-dom" (utter insignifigance and ridicule). I told David Young I wanted him to remove the article containing my name and the reference to the porn industry, primarily because it was based on a fabrication created by Steven Rich and fostered by Eric Jackson, and allowed by him. I told him that if he didn't, then I would write this article (actually, a series) and expose the depth of the relationship between his articles that appeared in the Estrella and the email he received from "William Smartlee." When he accused me of threatening him, I simply said I was not making any kind of threat, but just rather explaining what it is that I now intend to do (and, here it is.) Like I said before, when you get into my shit, I get into yours. David Young apparently does not yet fully comprehend the full depth of the load of shit he's been dragged into by Eric Jackson. Sooner or later, that realization will come to him, probably about the time he's called to testify. "Raise your right hand and repeat after me..."

I Expect This Slanderous Crap To Be Removed, Immediately

Published by Panama Guide under Crime & Punishment

Steven Rich
Steven Rich
By DON WINNER for Panama-Guide.com - And I want an apology, too. Steven Rich, using the alias "William Smartlee" sent a letter via email to Eric Jackson, the owner of a website called The Panama News. Jackson published this letter without verifying the veracity of what was being said, nor establishing the identity of the writer. Since Jackson now knows "William Smartlee" is actually Steven Rich, the same person he was corresponding with as "Ruth Osborn" who was trying to get him to publish (more crap) about my supposed ties to the CIA, Jackson should recognize Steven Rich was playing him for a fool. Steven Rich as able to convince there's a "connection" between me and the porno industry in Panama, simply because I know Mona Sutherland. Jackson should also recognize these asinine accusations about the porn industry in Panama are actually coming from someone who used to work for them. Steven Rich didn't have any problem with the porn industry while they were paying his bills, but only developed a distaste after the was fired for being a thief. Anyway, Jackson should remove the following from his website immediately and issue a personal apology. (more)

Jackson Published The Following: In the Letters To The Editor Section:

  • Winner's ties with the pornography industry

  • Fabian (snip), the Dutch national who runs a porn website empire in Panama, has been in the news lately.

  • Don Winner has connections with Fabian (snip) which I will explain after first providing you with the Panama Star stories about Fabian (snip) published last Tuesday and Wednesday.

  • The Panama Star newspaper recently published two stories about Fabian (snip) and his porn companies.

  • Fabian is mentioned by first name in this article.

  • The second article contains a reference to Fabian and Dana being investigated by the RCMP without mentioning their names:

  • In Canada where the RCMP (Royal Canadian Mounted Police) have a sophisticated network, fighting on-line child pornography, in association with other units around the globe and where Canadian law enables them to track and prosecute Canadian offenders anywhere in the world, a local tip off recently led to a check on a local “adult” distributor.

  • The next day’s online Panama Star has this story quoting Fabian (without mentioning his name).

  • That day’s printed version has more articles about the “expat and his wife” who run an Adult Entertainment empire. The online version doesn’t have these extra articles.

  • The connection between Don Winner and Fabian (snip) can be made with their relationship to Mona Sutherland, an American woman living in Panama. Mona Sutherland has been a friend and has worked with Don Winner for several years. The connections between them are tricky to prove because Mona Sutherland uses an alias in her porno articles "Mona Moore." This Word document breaks down who Mona Moore is by resumes and by photos in comparison to the real Mona Sutherland. Apparently, Mona Sutherland didn't want people to know that she is the notorious Mona Moore in the porno industry. Mona Moore is the same Mona Sutherland who works for Don Winner.

  • William Smartlee

But, Jackson Is A Punk Bitch: Undoubtedly, Eric Jackson will weakly argue "but I didn't write that..." as an excuse. He will try to make some bullshit technical argument, when what matters here are fundamental issues of right and wrong. What should be noted is that the editor of the English language section of the "Estrella" newspaper is David Young, that Eric Jackson also works there, and that David Young basically worships the ground Eric Jackson walks on. On 18 June 2009, Eric Jackson wrote the following for the "Estrella" -

  • In the electronic mailbox
  • 06-18-2009 | ERIC JACKSON
  • thepanamanews@gmail.com
  • As Mark Twain put it, “Denial ain't just a river in Egypt.” Here in Panama, it’s part of a day’s work

  • Panama Star Denials, denunciations, threats --- all part of a day's work. The worst of all are the foreigners who have heard about how the powers that be in Panama intimidate the press, and put on their exaggerated versions of how they think it ought to work.

  • I published a letter in The Panama News , about a woman who writes under an assumed name for pornographic web sites and helped to organize pornographer summits here. The letter included an attachment and many hyperlinks and documented its writer's allegations quite well.

  • Within minutes of the upload came the screeching phone call. At the point which it came to threats I hung up. There came 18 more calls in quick succession, which I didn't take, until to save the battery in my cell phone I turned the thing off. Mona Sutherland alias Mona Moore summarized by e-mail:

  • In light of what you have just written about me (under [a pseudonym] and I can prove that it is really you), I have decided to go ahead and proceed via my lawyer considering you have published "facts" that are untrue. I have been living in Panama for 4 years, and it's not very difficult for me to get to the bottom of issues either. You make grave mistakes talking about people you know nothing about via your pathetic excuse of a C-rate online newspaper.

  • My lawyer will be in touch soon, Mona M. Sutherland.

  • Ah, yes. She's going to prove a false assertion about the letter's authorship. It wouldn't be the first time that was done in a Panamanian court. And what did she say were the "'facts' that are untrue" upon which her lawyer is going to build a case?

  • "I do not work for Don Winner." But indeed, she runs Mr. Winner's "Young Expats in Panama" e-mail chat group. Moreover, Ms. Sutherland asserted to Panama Star reporter Marijulia Pujol Lloyd , she "was never involved per se in the pornographic industry" and Winner has no ties to it.

  • Writing as "Mona Moore" on the Klixx website, Ms. Sutherland puts it this way:

  • We are all in adult and love it, but since it has always been an industry that lounges on the shores of the mainstream as opposed to immersing itself, we often find ourselves having to go an extra mile to ensure smooth business operations. In the case of models, it is finding women that enjoy their job and stick around for more than a couple of months.

  • [It is] essential to assess a potential model’s personality, asking themselves questions such as.. Does she like sex? Does that come across on camera?

  • And Don Winner? Other than having Sutherland/ Moore running one of his e-mail groups? Other than hanging out with Fabian Buys ? Do a Google search using the keywords "Panama" and "hookers." Why does Winner's copyright pirate web site, the Panama Guide, come up first?

  • It's because he puts all these teasing tag words in his web site, so as to attract people who think that they will be clicking onto a pornographic web site and in that way deceptively drive up the alleged readership numbers of his publication.

  • Anyway, as somebody who has two JDs -- the doctorate in jurisprudence and the juvenile delinquent record -- I must admit to getting these perverse kicks contemplating a calumnia e injuria case wherein what is alleged to be false and defamatory is someone else's characterization of Ms. Sutherland alias Moore running an e-mail group for Don Winner as "working for" him.

  • All in a day's work, here at 9° North.

How About Now, Eric Maybe it's my turn for a few "perverse kicks." But I won't sue you - I'll just report extensively on the efforts of someone else who has a whole lot more resources at their disposal than I do. So, are you willing to "stand by" all of the bullshit Steven Rich sent you, now that you know it's source and the motivations behind the author? One more notch taken off of the "credibility" scale for Eric Jackson. But we already knew that, didn't we.

Steven Rich’s Big Mistake – Coming After Me

Published by Panama Guide under Crime & Punishment

Steven Rich
Steven Rich
By DON WINNER for Panama-Guide.com - We all make mistakes, it's part of being a human. Steven Rich made one big mistake while working for Fabian and Klixxx magazine. He got falling down drunk at an important client event, got caught stealing on surveillance security videotape, and was fired for this actions. If he had just moved on at that point then nothing further would have happened. But, Steven Rich's next series of significant errors began when he tried to convince me and at least four other journalists to publish his false allegations that Fabian's company was involved in the production, editing, and international distribution of child pornography. It took him more than nine months to get someone to bite, and eventually David Young, the editor of the English language version of the "Estella" newspaper here in Panama, decided to run the story without every verifying the actual identity of their primary source of information, which in fact was Steven Rich using the alias "William Smartlee." Steven Rich's next big mistake was to try to drag me into this entire mess and to convince Eric Jackson to publish a story that I was supposedly working for the CIA, using yet another ficticious email personality, "Ruth Osborn." I have to be honest, I saw all of the stuff the Estrella published and thought "so what." But when Steven Rich started coming after me, he really got my undivided attention. (more) Steven Rich Was Fired This Morning: Early this morning Steven Rich was confronted my his former employers. He denied any involvement in anything and claimed to have limited knowledge. The evidence against him was so profound and conclusive that the partners in that law firm took the correct decision to terminate him on the spot because of his actions. Therefore, as of this moment Steven Rich is now unemployed.

I Just Spoke To Him On The Phone: Steven Rich is in complete and total denial. He said he wanted to apologize to me. When I asked him why, he said he was "sorry that I got drug into this mess - it's a big mess." I reminded him that it was a mess of his creation, and that if he had not sent out literally hundreds of emails using the alias "William Smartlee" with the intent of causing damage to Fabian's business, then none of this would have happened. Steven Rich continued to deny any involvement. I asked him point blank - "Are you William Smartlee?" His response was that "at this moment I cannot confirm or deny anything." I asked him if he had sent a series of emails to Eric Jackson using the alias "Ruth Osborn" trying to claim that I was in the CIA. He again denied having any involvement. He tried to say that someone hacked into his computer and that apparently some other person had taken over his computer or something like that. I advised him that, at that point in time, I was the one person on the planet that he could not bullshit. His two options are to either admit what he had done and basically "man up" - or continue to be a lying bitch. He took the bitch option, and again denied responsibility, etc. He said again that he just wanted to apologize, and I asked him what he was apologizing for if he had not done anything wrong. I suggested that, since he was still sending out email on Saturday afternoon (20 June 2009) to Eric Jackson, trying to get him to bite on the whole bullshit "CIA" angle, that he was only sorry that he had gotten caught that he will now have to answer for his actions. He had nothing else to say, so I hung up.

Mona Sutherland Figured It Out: In an article entitled Porno host site or call center? that appeared in the English language version of the Estrella newspaper, the author, MARIJULIA PUJOL LLOYD, tried to make a connection between me, Mona Sutherland, and the porn industry. Thanks to more email send from Steven Rich using the alias William Smartlee, Eric Jackson published those allegations on his website, which were echoed by the Estrella. Apparently, just knowing Mona Sutherland was sufficient for the Estrella to publish my name. Of course Mona reacted and she spoke to me on the phone about this article. At that point I had not yet confirmed the identity of "William Smartlee" as Steven Rich, and for the record I "woke up" on this story on 16 June 2009 when the Estrella published my name. At this point Mona Sutherland was thinking that "William Smartlee" was actually Eric Jackson, but I told her she was most likely incorrect. I told her that William Smartlee was going to be someone who had worked with her at the magazine while she was there, someone who was a former employee of Fabian, and someone who had either been fired or who was relieved for cause, and who had an ax to grind with Fabian. A few days later Mona wrote an email to "William Smartlee" address saying "This is Steven who used to work for Klixxx, right?" Steven Rich didn't respond to her email but he did respond to the fact that someone had figured him out. Almost immediately Steven Rich wrote to Eric Jackson, asking him to remove the information he had sent as a letter to the editor, which tried to link me to the porn industry through Mona Sutherland. And that very same day he created a new alias to attack me, "Ruth Osborn."

Police Operations in Chilibre – Searching for Armored Car Robbers

Published by Panama Guide under Crime & Punishment
